Terms of Service
Plain-language summary
- What this is. LithiumOps is a research and intelligence tool. It organises information about lithium projects, companies and markets so you can find it faster.
- Where the data comes from. Everything we publish is compiled from publicly available sources — technical reports, regulatory filings, company disclosures, government registries and public news. We do not sell confidential or non-public information.
- What a subscription buys. Access to the platform as it exists at the time you subscribe. It does not guarantee that any specific project, field, figure or document you are looking for is included.
- The plans. Free covers the map with a selection of projects, basic news, the Learning hub and Market Data. Pro adds the complete project database on the map. Premium adds analytics, engineering tools, the detailed project explorer and data export. Current prices are always the ones published on the pricing page.
- How paying works. Monthly plans have a one-time Market Intelligence Access fee charged with your first payment, plus the monthly subscription. Annual plans are a single flat price with no access fee. The price you sign up at stays fixed for 24 months.
- Refunds. 14-day money-back guarantee, no questions asked. Write to us within 14 days of your purchase and we refund everything you paid. See our Refund Policy.
- "Coming soon" features. Some Premium features are still on the roadmap. They are included at no extra cost when released, but we do not commit to a date. Subscribe for what is live today, and if a roadmap feature matters to you, ask us before paying.
- Not advice. Nothing here is investment, financial, legal, engineering or geological advice. Verify against primary sources before making decisions.
- Fair use. Your account is personal. No scraping, no bulk extraction, no resale or redistribution of our data.
This summary is provided for convenience only. The full terms below are the binding agreement.
1. Acceptance of these Terms
These Terms of Service (the "Terms") form a binding agreement between you ("you", "User") and LithiumOPS SpA, tax ID 78.448.252-9 ("LithiumOps", "we", "us"), governing your access to and use of the LithiumOps website, platform, data, maps, dashboards, APIs and related services (together, the "Service").
By creating an account, subscribing to a paid plan, or otherwise accessing the Service, you confirm that you have read, understood and accepted these Terms, together with the Privacy Policy and the Data Disclaimer, which are incorporated into these Terms by reference. If you do not agree, you must not use the Service.
If you accept these Terms on behalf of a company or other legal entity, you represent that you have authority to bind that entity, and "you" refers to that entity.
2. Definitions
- "Content" means all data, records, project profiles, coordinates, estimates, indicators, charts, maps, text, graphics and other materials made available through the Service.
- "Public Sources" means information that is publicly accessible, including but not limited to technical reports (NI 43-101, JORC, PEA, PFS, DFS), regulatory and stock-exchange filings, corporate presentations and press releases, government and mining-registry databases, scientific literature, and public news outlets.
- "Free Plan" means access to the Service without payment, currently comprising the global map with a limited selection of projects, the basic news section, the Learning hub and the Market Data views.
- "Paid Plan" means any subscription tier requiring payment — currently "Pro" and "Premium" — at the prices published on our pricing page at the time you subscribe.
- "Initial Access Fee", shown at checkout as "Market Intelligence Access", means the one-time payment that unlocks the complete project database for your account. It applies to monthly Paid Plans only and is charged once, together with the first subscription payment. Annual Paid Plans do not carry it.
- "Price Lock Period" means the twenty-four (24) months from the start of your Paid Plan during which the price you subscribed at does not change, as described in Section 7.
- "Subscription Period" means the billing cycle applicable to your Paid Plan: one (1) month where you select monthly billing, or twelve (12) months where you select annual billing.
- "Roadmap Feature" means any feature identified on the pricing page or elsewhere in the Service as "Coming soon", planned, beta or preview.
3. Description of the Service
LithiumOps is a lithium-sector intelligence platform. The Service aggregates, structures, normalises and visualises information about lithium projects, deposits, producers, processing technologies, market prices, listed companies and sector news, and presents it through an interactive map, dashboards, analytics views and editorial modules.
The Service is a research and information tool. It is designed to reduce the time you spend locating and organising sector information. It is not a substitute for primary-source review, technical due diligence, or professional advice.
4. Nature and origin of the information
All Content available through the Service is compiled exclusively from Public Sources. LithiumOps does not provide, and does not undertake to provide, confidential, proprietary, privileged, insider or otherwise non-public information of any kind.
Our contribution is the collection, verification effort, structuring, normalisation and presentation of information that is already publicly available. You are not paying for exclusive or private data; you are paying for access to an organised, searchable and visualised compilation of public information.
4.1 Consequences of relying on Public Sources
Because the Content originates from third-party Public Sources, you expressly acknowledge and accept that:
- The accuracy, completeness and timeliness of the Content depend on the accuracy, completeness and timeliness of the underlying Public Sources, over which we have no control.
- Public Sources may be outdated, inconsistent between each other, partially disclosed, subject to later restatement, or withdrawn by their issuer.
- Technical and economic figures (resources, reserves, grades, CAPEX, OPEX, NPV, production capacity, life of mine, timelines) are as reported or estimated by their original issuer, and are frequently preliminary, conditional or based on assumptions we cannot independently audit.
- Where the Content includes calculations, conversions, unit harmonisation, categorisations, rankings or estimates produced by LithiumOps, these are derived interpretations and are informational in nature, not verified facts.
- Coordinates, boundaries and map locations are approximate and are provided for orientation only. They do not represent legally surveyed positions, concession boundaries or property rights.
4.2 Reporting inaccuracies
If you identify Content you believe to be inaccurate or out of date, you may notify us at contact@lithiumops.com. We will review such reports in good faith, but we do not commit to any specific correction timeframe and are under no obligation to modify the Content.
5. Scope of access — no guarantee of specific content
A subscription grants access to the Service as it exists, in its then-current state, during your Subscription Period. It does not constitute a commitment to provide any particular project, company, country, dataset, field, figure, document, indicator or level of detail.
Subscribing does not mean, and must not be understood to mean, that the Service contains all the information you are looking for, that it covers every lithium project or asset worldwide, or that every project included is documented to the same depth. Coverage is inherently limited by what has been publicly disclosed and by our editorial and technical capacity to process it.
5.1 What you are contracting
You are contracting access to a platform and to the compilation of Content available on it at any given moment. You are not contracting:
- a research service, a data-on-demand service, or a commitment to locate specific information for you;
- exhaustive or global coverage of the lithium sector;
- a uniform level of detail across all records — some projects include full economics, others only basic identification;
- the continued presence of any specific record, which may be removed, merged, corrected or reclassified at any time;
- any particular feature, module or dataset described as planned, upcoming or "coming soon", which remains subject to change or cancellation without liability.
5.2 Feature availability by plan
Features and depth of Content differ between the Free Plan and each Paid Plan, as described on the pricing page. In summary, and without warranty as to quantity or completeness:
- Free Plan — global map with a limited selection of projects, basic news section, full Learning hub and Market Data (lithium price charts and the listed-company dashboard).
- Pro — everything in the Free Plan, plus access to the complete project database on the map, across all development stages and deposit types, without watermarking.
- Premium — everything in Pro, plus the Analytics module, engineering calculation tools, the detailed project explorer with filters, data export, and the weekly report summarising news and project updates.
The description of a plan reflects the categories of functionality unlocked, not a warranty as to the quantity, granularity or completeness of the records within those categories.
5.3 Roadmap Features
Certain features included in a Paid Plan are identified as Roadmap Features ("Coming soon") because they are not yet available. Where a Roadmap Feature is listed within a plan, it is offered as an expectation of future inclusion at no additional cost, and not as a present deliverable. We give no commitment as to release date, final scope or eventual release at all, and we may modify or cancel any Roadmap Feature without liability. Your decision to subscribe should be based on the features that are live at the time you subscribe. If a Roadmap Feature is essential to you, contact us before purchasing.
5.4 Coverage is not a warranty
Given the above, the absence of a specific project, field, figure or document from the Service does not constitute a defect, a breach of these Terms, or a failure of the Service. We recommend that you evaluate coverage using the Free Plan, and contact us before subscribing if a particular scope matters to you. Whatever you decide, our 14-day money-back guarantee applies.
6. Accounts and eligibility
You must be at least 18 years old and legally capable of entering into binding contracts. You agree to provide accurate registration information and to keep it up to date.
Accounts are personal and non-transferable. You are responsible for maintaining the confidentiality of your credentials and for all activity carried out under your account. Credential sharing, concurrent use by multiple individuals, or the use of a single account across an organisation is prohibited unless expressly agreed in writing under a multi-seat arrangement. Notify us immediately at contact@lithiumops.com of any unauthorised use.
7. Plans, fees and billing
Plan features and prices are published on the pricing page. Prices are stated in United States dollars (USD) and are exclusive of any applicable taxes, duties or withholdings, which are your responsibility unless the law requires us to collect them.
Paid Plans are offered on two billing cycles, at your choice at checkout:
- Monthly — a one-time Initial Access Fee, charged together with the first monthly payment, plus the recurring monthly subscription fee.
- Annual — a single flat payment covering twelve (12) months. Annual plans do not carry the Initial Access Fee.
The exact amount of each fee is the one displayed on the pricing page and confirmed at checkout before you pay. We run limited pricing tiers (for example a fixed number of founding memberships); once a tier is full, new subscriptions are taken at the next published price. The tier available to you is the one shown at the moment you subscribe.
7.1 Price Lock Period
The price you subscribe at does not change for twenty-four (24) months, provided your subscription remains continuously active. At the end of that period your plan moves to the price then in force, reduced by a permanent thirty per cent (30%) loyalty discount, and we will notify you at least sixty (60) days before that change takes effect. If you cancel and subscribe again later, you do so at the price published on that later date; the lock follows the subscription, not the account.
7.2 Billing
- Paid Plans are billed in advance for the full Subscription Period. Monthly plans are charged each month; annual plans are charged once for the twelve-month period.
- Annual pricing is offered in consideration of the twelve-month commitment. Switching from an annual to a monthly plan takes effect at the end of the annual Subscription Period already paid.
- Where you upgrade mid-period (for example from Pro to Premium), we apply the unused value of your current Subscription Period as a credit against the new plan and charge only the difference.
- The Initial Access Fee is charged once per account. If you have already paid it and later resubscribe, it is not charged again.
- Payments are processed by Paddle.com Market Ltd, acting as merchant of record. We do not store full card details on our servers.
- By subscribing, you authorise us and our payment provider to charge your payment method for the applicable fees, including renewals.
- Outside the Price Lock Period, we may change prices for future Subscription Periods with at least thirty (30) days' prior notice by email or in-product notification. Price changes never apply retroactively to a Subscription Period already paid.
- If a payment fails, we may suspend or downgrade your access until payment is regularised.
8. Renewal, cancellation and refunds
8.1 Automatic renewal
Unless stated otherwise at checkout, Paid Plans renew automatically at the end of each Subscription Period for an equivalent period, at the then-current price, until cancelled.
8.2 Cancellation
You may cancel at any time from your account settings or by writing to contact@lithiumops.com. Cancellation stops future renewals, and your access continues until the end of the Subscription Period already paid. Cancelling and asking for your money back are separate things: for the second, see 8.3.
8.3 Refunds — 14-day money-back guarantee
If you are not happy with the Service for any reason, write to contact@lithiumops.com within fourteen (14) days of your purchase and we will refund you in full. No questions asked.
The guarantee covers everything you paid us for that purchase: the subscription fee and the Initial Access Fee.
Payments are collected by Paddle.com Market Ltd as merchant of record, so refunds are issued through Paddle to the payment method originally used. You may send your request to us or raise it directly with Paddle. Our full Refund Policy says the same thing in plain language.
8.4 Consumer withdrawal rights
Where you qualify as a consumer under applicable law and that law grants you a statutory right of withdrawal or cancellation, that right applies in addition to the guarantee above. Where the law gives you more than this Section gives you, the law wins.
9. Licence and permitted use
Subject to your compliance with these Terms and payment of applicable fees, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable licence to access and use the Service and to consult the Content for your own internal professional, academic or informational purposes.
Within that licence, and provided the source is credited as "LithiumOps", you may:
- consult, display and read the Content on screen;
- include isolated, non-substantial extracts of the Content in internal documents or presentations of your organisation;
- use Content as a starting point for your own analysis, subject to independent verification against primary sources.
10. Prohibited conduct
You must not, directly or indirectly:
- scrape, crawl, harvest, mirror, index or systematically extract the Content by automated or manual means;
- reproduce, republish, resell, sublicense, rent, lend or otherwise commercially exploit the Content or the Service, or build a competing or derivative product or database from it;
- share, sell or transfer your credentials, or allow access by any person other than the authorised account holder;
- remove, obscure or alter watermarks, attribution notices or access limitations, including those applied to premium or restricted records;
- circumvent or attempt to circumvent authentication, plan restrictions, rate limits or any technical protection measure;
- reverse-engineer, decompile or disassemble any component of the Service, except to the extent this restriction is unenforceable under applicable law;
- use the Service to violate any law, sanctions regime, export control or third-party right;
- interfere with the security, integrity, availability or performance of the Service, or introduce malicious code;
- use the Content as the primary or sole basis for any public statement, prospectus, valuation, regulatory filing or investment recommendation.
We may monitor usage patterns to detect abuse and may apply rate limits, technical countermeasures, suspension or termination in response.
11. Intellectual property
The Service — including its software, interface design, visual identity, map layers, editorial writing, taxonomies, structure, normalisation methodology and the selection and arrangement of the Content — is owned by LithiumOps or its licensors and is protected by copyright, database, trademark and other intellectual-property laws.
Underlying facts contained in Public Sources are not owned by us; however, our compilation, structuring and presentation of those facts constitutes a protected database and editorial work. Nothing in these Terms transfers any ownership right to you.
"LithiumOps", our logo and other brand elements are our trademarks. You may not use them without prior written consent, except to refer to the Service factually. Third-party names, marks and logos appearing in the Service belong to their respective owners and are used for identification only, without implying any affiliation or endorsement.
12. Third-party content and services
The Service integrates or displays content and tools supplied by third parties, including market-data and charting widgets (such as TradingView), news feeds and syndicated headlines, map tiles and geographic base layers, payment processing, hosting and authentication providers.
Such third-party content and services are provided by their respective owners, remain subject to their own terms and policies, and may be modified, degraded or discontinued without notice. We do not control, endorse, verify or assume responsibility for third-party content, including the accuracy or timeliness of market quotes, prices or news headlines, which may be delayed or erroneous. Links to external sites are provided for convenience only.
13. No professional or investment advice
The Service and its Content are provided for general informational purposes only and do not constitute investment, financial, trading, tax, legal, accounting, engineering, geological, metallurgical or environmental advice, nor an offer, solicitation or recommendation to buy, sell or hold any security, commodity or asset, nor a valuation, fairness opinion, competent-person report or technical report of any kind.
LithiumOps is not a registered investment adviser, broker-dealer, financial institution or qualified person under any mineral-reporting code. Any decision you make — investment, commercial, technical, operational or otherwise — is taken at your sole discretion and risk, and must be based on your own independent verification, primary-source review and, where appropriate, qualified professional advice.
14. Disclaimer of warranties
To the maximum extent permitted by applicable law, the Service and the Content are provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory.
We expressly disclaim any warranty of:
- accuracy, completeness, currency, reliability or fitness of the Content for any particular purpose;
- coverage of any specific project, company, jurisdiction, dataset or field (see Section 5);
- uninterrupted, timely, secure or error-free operation of the Service;
- correction of defects, or compatibility with your systems or workflows;
- merchantability, non-infringement or fitness for a particular purpose.
No advice or information obtained from us or through the Service creates any warranty not expressly stated in these Terms. Some jurisdictions do not allow the exclusion of certain warranties; in that case, the exclusions apply to the fullest extent permitted.
15. Limitation of liability
To the maximum extent permitted by applicable law:
- LithiumOps, its directors, employees, contractors and suppliers shall not be liable for any indirect, incidental, special, consequential, punitive or exemplary damages, nor for loss of profits, revenue, business opportunity, data, goodwill or anticipated savings, arising out of or in connection with the Service or the Content, even if advised of the possibility of such damages.
- In particular, we shall not be liable for any loss resulting from: reliance on the Content; errors, omissions or outdated information originating in Public Sources; the absence of information you expected to find; interruption, suspension or discontinuation of the Service; or the acts, omissions or content of third-party providers.
- Our aggregate liability arising out of or relating to these Terms or the Service shall not exceed the total amount actually paid by you to LithiumOps in the twelve (12) months immediately preceding the event giving rise to the claim, or USD 100 if you use the Free Plan.
Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, gross negligence, death or personal injury, or any other liability that cannot lawfully be excluded.
16. Indemnification
You agree to indemnify, defend and hold harmless LithiumOps and its directors, employees and contractors from and against any claim, demand, proceeding, loss, liability, damage, cost or expense (including reasonable legal fees) arising out of or related to: (a) your use of the Service or the Content; (b) your breach of these Terms or of any applicable law; (c) your infringement of any third-party right; or (d) any decision, publication or representation you make on the basis of the Content.
17. Changes to the Service
We are continuously developing the Service. We may add, modify, restrict, suspend or discontinue any feature, module, dataset, record or integration at any time, including features currently offered under a given plan, provided that we do not materially degrade the core functionality you paid for during a Subscription Period already in progress.
If we permanently discontinue the Service in its entirety, we will provide reasonable notice and refund the unused pro-rata portion of any prepaid fees, which shall be your sole and exclusive remedy.
18. Suspension and termination
We may suspend or terminate your access immediately if you breach these Terms — in particular Sections 6 (account sharing) and 10 (prohibited conduct) — if payment fails, if required by law, or if your use poses a security, legal or reputational risk.
You may terminate at any time by cancelling your subscription and ceasing to use the Service. Upon termination, the licence in Section 9 ends immediately. Sections 4, 5, 11, 13, 14, 15, 16, 21 and 22 survive termination.
19. Privacy and personal data
Our processing of personal data is described in the Privacy Policy, which forms part of these Terms. By using the Service you acknowledge that processing.
20. Changes to these Terms
We may update these Terms to reflect changes in the Service, our business or the law. The version in force is always the one published at this URL, identified by its effective date and version number.
For material changes, we will provide at least thirty (30) days' notice by email or in-product notification before they take effect. Continued use of the Service after the effective date constitutes acceptance. If you do not accept the new Terms, you must stop using the Service and may cancel your subscription; where the change materially and adversely affects you, you may request a pro-rata refund of the unused portion of the current Subscription Period.
21. Governing law and dispute resolution
These Terms are governed by the laws of Chile, without regard to conflict-of-law rules. Any dispute arising out of or in connection with these Terms or the Service shall be submitted to the exclusive jurisdiction of the ordinary courts of Santiago, Chile.
Where you qualify as a consumer, this clause does not deprive you of the protection of mandatory provisions, or of the right to bring proceedings before the courts of your place of residence, where applicable law so provides.
Before initiating formal proceedings, the parties agree to attempt in good faith to resolve the dispute by writing to contact@lithiumops.com and allowing thirty (30) days for a response.
22. General provisions
22.1 Entire agreement
These Terms, together with the Privacy Policy and the Data Disclaimer, constitute the entire agreement between you and LithiumOps regarding the Service and supersede all prior communications, proposals and representations.
22.2 Severability
If any provision is held invalid or unenforceable, it shall be limited or severed to the minimum extent necessary, and the remaining provisions shall remain in full force.
22.3 No waiver
Our failure to enforce any right or provision shall not constitute a waiver of that right or provision.
22.4 Assignment
You may not assign or transfer these Terms without our prior written consent. We may assign them in connection with a merger, acquisition, reorganisation or sale of assets.
22.5 Force majeure
Neither party shall be liable for failure to perform caused by events beyond its reasonable control, including natural disasters, war, civil unrest, labour action, epidemics, changes in law, failures of telecommunications, hosting or third-party data providers, or cyber-attacks.
22.6 Notices
We may send notices to the email address associated with your account or display them in-product. You may send notices to contact@lithiumops.com.
22.7 Language
These Terms are drafted in English. Any translation is provided for convenience only; in case of discrepancy, the English version prevails, except where applicable consumer law requires otherwise.
22.8 Beta and preview features
Features labelled beta, preview, experimental or "coming soon" (Roadmap Features) are provided without warranty of any kind and may be modified or withdrawn at any time. They do not form part of the committed scope of any plan. See Section 5.3.
23. Contact
Questions about these Terms can be directed to contact@lithiumops.com, or through the contact form available on our home page.
